Understanding the Social Security Disability Insurance Process

If you suffer from a disability in Las Vegas that makes it impossible for you to work, you might be entitled to Social Security Disability Insurance (SSDI) benefits. These benefits are monthly cash benefits paid to eligible recipients by the Social Security Administration. You will need to submit an application for SSDI benefits with your local Social Security Administration office.

While it is possible to submit an application on your own, hiring an experienced SSDI lawyer will increase your chances of approval. At Roeschke Law, LLC, we dedicate our entire legal practice to helping our clients successfully obtain Social Security benefits. The process of applying for SSDI is incredibly complex. When you work with our law firm, you can rest assured that our lawyers will represent your best interests throughout the entire process.

What to Expect at a Social Security Disability Insurance Hearings

Many of our clients find the thought of a hearing somewhat intimidating. Hearings are not intimidating when you have an experienced lawyer by your side. At Roeschke Law, LLC, we will walk you through the hearing process so you won’t be taken by surprise. Our lawyers take the time to thoroughly investigate and prepare for all of our clients’ cases.

Typically, Social Security Disability Insurance hearings are conducted over the phone. You can request for the hearing to be in person, however. Most Social Security hearings are similar, but there can be slight variations, depending on the administrative law judge who is overseeing your case.

Hearings are not open for the public, so if you bring a friend, he or she will need to wait outside. You, your lawyer, the administrative law judge, and a hearing assistant will be present at the hearing. The Social Security Administration may hire one or two expert witnesses to testify at your hearing. These experts will testify about your medical condition and how a particular condition can negatively affect a person’s life. The administrative law judge will seek to understand whether or not your condition truly prevents you from working at your current job, or any other job.

The Disability Hearing Process in Las Vegas

After the judge identifies everyone in the room, he or she will read a statement of facts. The statement will include facts about your Social Security Disability Insurance application. In most cases, the judge will then question you directly. The questioning isn’t as intense as questioning you might see during a television trial. The process is more casual and often has the tone of a meeting. Keep in mind that you will be under oath, however.

The judge will ask you and any expert witnesses questions. The judge will likely ask you about the limitations of your disability, and your past employment. He or she will also ask about how your disability limits your ability to work and function in your day-to-day activities. We can help you prepare to answer any questions the judges ask you.

During the hearing, the judge will seek to gather all of the facts needed to make a decision on whether or not you’re entitled to disability benefits. Answering the judge’s questions honestly is extremely important. Our SSDI legal team can help you write down specific examples of how your disability negatively impacts your everyday activities.

After the Disability Hearing in Las Vegas

In most cases, you will not receive a decision at the end of the hearing. Typically, the Social Security Administration will send an opinion 3-4 weeks later. In rare cases, an administrative law judge will issue a “bench decision.” When they do so, they will tell you whether or not they will approve your application before the hearing. You will still need to wait to receive the written decision before you can begin receiving monthly benefits.
